Estate Planning & Elder Law


Mr. Sachdev is an experienced estate planner.  He has helped clients with various wealth
levels achieve their estate plan with emphasis on gift & estate tax planning. He works closely
with your financial professionals such as accountants, insurance agents, investment and
financial advisors to help preserve the wealth of his clients.  He has also helped seniors with
their needs.  He is a member of
National Academy of Elder Law Attorneys (NAELA).   He
holds a Certificate of Completion in the areas of Probate and Estate Planning issued by
Institute of Continuing Legal Education and Probate and Estate Planning Section of the State
Bar of Michigan.  Our firm provides services in these areas:

Estate Planning: Wills and Living Trusts – At a very initial level of planning it is the objective of
our firm to help our clients avoid probate and minimize their estate taxation.  We do not provide a
cookie-cutter service or plan for every client.  Instead, we will make sure that each plan is so
devised to help our client meet his/her goals and achieve with maximum security and benefits
under the current existing state and federal laws.  We use a combination of Wills, Revocable
Living Trusts, Durable Power of Attorneys (Healthcare and Finance) to provide such a plan.  Use
of Marital Deduction and Credit Shelter Trusts and their careful funding provides for a maximum
savings on estate taxes while making sure that the surviving spouse is not impoverished. Given the
frequent changes in law, a constant review is required – at least on an annual basis.  For small
business owners we include succession planning with advanced taxation issues to help them
transition their years of hard work to another generation.

Estate Planning for Non-Citizens – Did you know that unlimited marital deduction is not
available to a surviving spouse who is not a U.S. citizen?  This is to prevent the non-citizen
surviving spouse from leaving the country after receiving funds in the trust (upon the death of the
spouse).  Special provisions in the IRS Code apply when at least one of the spouses is a non-U.S.
citizen.  By the use of Qualified Domestic Trust (QDOT), we can ensure that the non-U.S. citizen
surviving spouse is provided same tax benefits, as a U.S. Citizen would, if they were to become a
trustee upon the death of their spouse.  

IRA & Retirement Planning – Individual Retirement planning extends beyond the death of a
person.  Extensive use of IRA trusts (where the trust receives benefits instead of an individual
beneficiary) makes sure that not only the surviving beneficiaries get to enjoy the use of the money
but their own beneficiaries as well. This also provides additional protection from creditors in
general and especially during Bankruptcy proceedings.  The idea is to preserve your retirement
assets for your successors and then again for them to preserve for their succeeding generations.  
This is a very specialized function but necessary and beneficial for an estate plan where there is a
significant amount of funds in IRAs.  Certainly, not a do-it-yourself!

Charitable Gifting Strategies – Nothing can be more fulfilling than knowing today, that after
you have passed-on, your gifts will continue to make a difference in the lives of others.  Arrange
with us now to have a clearly defined objective and make sure that your wishes are followed.  We
can analyze your situation and through the creation of special trust vehicles (GRATs, GRITs and
GRUTs), and provide shape to your gifting strategies.  Significant income tax deductions, if
applicable to your situation, make it more attractive to use charitable gift giving a part of your
overall estate planning strategies.

Incapacity Planning – We help clients in planning for their needs should they become
incapacitated and are unable to carry on their functions which require regular decision making.  
We draft Durable Power of Attorney for Healthcare that would provide for your continued care in
the absence of your decision making abilities.  The documents shall have provisions to authorize
your representatives to be able to receive your healthcare information which is protected for
privacy under law.  Also included are parameters for organ-donation and cessation of life support
system, if necessary.  Through careful planning, we draft Durable Power of Attorney for
Finances that appoint a trustworthy person to care for your financial aspects during your
incapacity.  A good planning entails identifying both trustworthy persons to act on your behalf
during your incapacitation and your choice on what you want them to decide on.  

Elder Law & Medicaid Services – The single most important issue affecting our Elder citizens is
the high cost of nursing homes.  Such costs have the capability to wipe out your asset base and
leave nothing for your heirs.  Recent changes in law for Medicaid Planning and Estate Recovery in
Michigan, have made it necessary for everyone to plan for such a situation in your life.

Special Needs Planning – Our customized plans are geared towards your specific needs.  If you
have a member of your family who needs special assistance, our firm can provide you with help
to care for those needs.  We work with you to help identify the needs that should be covered in
such documents that would provide for the specific needs of your family member.
